In New York, the 2nd Circuit has hired "RWing" to handle Judge Rakoff's case. is this just satire, snark or something greater Hidden. There's very little debate on the fact of, whether or not, America as a whole has lost faith in the system of justice. We have cops pepper spraying and beating up Occupiers unjustly, the Trayvon Martin murder case in Florida of a white man "stalking" a black teenager and killing him. Former Bushies like Rove getting a pass on Perjury and the DOJ Whistleblower Protection Director (Scott Bloch) destroying case files forcing an FBI raid of his Department of Justice Special Counsel's office. Yet Mr. Bloch plead guilty and refuses to do even 1 months jail time as being too harsh a punishment for the betrayal of public trust and is office oath & duty.
What has harmed America more than anything else - currently; are the Wars unjust and Bailouts/ Bargains made by the SEC and DOJ with White Collar skullduggery that makes Madoff schemes look like child's play. This is why many of us are calling the SEC, the "Selective Enforcement Commission". In New York Superior Court, Judge Rakoff is trying to put a stop to that moniker's verity by challenging the SEC purported $281 Million settlement with Citibank for serious fraud in a $1 Billion Bond issue. (See Wall Street Journal Story (here) (here) and (here). Then, the SEC barks about Judge Rakoff's interference with the SEC's decades long historical rights and practices (here) and (here).
Judge Rakoff simply asked 9 relevant questions of the SEC - including the question of it is is Proper for the public to have a settlement without a deny or confess of wrong doing (see the question PDF (here). The one story from the Wall Street Journal that summarizes the Rakoff/ SEC battle is (here).
Their "practices" ARE the problem.
Judge Rakoff simply said no to a settlement without admitting wrong doing. Regardless of what you feel about the Judge Rakoff (Wiki pic right) - or his previous decisions - this is a major step in the right direction for America. We need more of this stand against bull crap settlements with White Collar "Criminal" enterprising - simply because they are called BANKS. Thus, below the squiggy - I wish to spark a reflection for debate on the issue of settling wrong doing and specifically discuss the fact that it encourages more bad faith acts. There are Bailouts and Bargains you may not be aware of and willful blindness by the Department of Justice extraordinary; which needs fixing. Including that of the mortgage crisis. It is my heartfelt belief that MERS has to go down or we are all doomed - because it is a mass proof of what is systemicly and incestuously wrong in America. They get to plunder, pirate and steal a ga Zillion dollars and pay a mere percentage of millions in fines. -------------That's B S.
